California Penal Code 2002:
Health & Safety Code § 11358:
Every person who plants, cultivates, harvests, dries, or processes any marijuana or any part thereof, except as otherwise provided by law, shall be punished by imprisonment in the state prison.
Cultivating even a single marijuana plant is a federal felony and like trafficking and distribution charges may trigger mandatory minimum sentences and if in an area that has been designated ‘drug free’ (school areas for instance) a defendant charged in federal court with growing a single marijuana plant in his kitchen a block from a school building may be subjected to a mandatory minimum sentence in prison.
