Enforcing California’s Labor Laws
Monday by: DoreenIn today’s economy, people can become desperate to find a job, any job, in order to survive and feed their families. A job that doesn’t withhold taxes can seem like a dream come true. Money that changes hands “under the table” can be easier to come by than money earned from working for a legitimate business. However, beware of underground businesses and their labor practices. Remember that the laws are in place to protect your rights as an employee.
California has created the Economic and Employment Enforcement Coalition in order to be able to investigate companies and small businesses who do not work legitimately. They enforce the minimum wage, safe working conditions, and benefits, such as paid leave, that employees are entitled to under federal and state laws. They prevent employers from taking advantage of the poor, children, and immigrants, who are more vulnerable to agreeing to work long hours for little wages. If all businesses would abide by the law, California would have a much stronger economy because they could compete fairly.
Just this month, Cal/OSHA investigators shut down both a farm and a construction site for not providing adequate shade, water, and breaks for workers who were working outside in heat that measured 97 degrees and higher. They may be fined and/or sentenced to jail time for ignoring the laws that protect their workers.
Remember that legal California residents are entitled to fair wages and a safe working environment. If you feel that your rights as an employee have been violated, seek sound legal advice from an experienced attorney.
