California DUI Penalties

Roadside Sobriety TestPut simply, a list of possible penalties for punishment of DUI under California state law:

First Offense DUI:

Incarceration: 4-180 days

Fines: $390-$1,000 with the possible addition of penalty valuations

Suspension of Driver’s License: 120-day suspension.  Defendant may possibly apply for hardship permit after 1 month. If the defendant is under the age of 21, 12-month suspension is required.

Ignition Interlock Device (IID): Court has discretion on whether an IID is necessary.

Impound of Vehicle: Court has discretion on whether vehicle should be impounded and when/if vehicle should be released.

DUI School: 90 days or longer in cases where high BAC is a factor

Probation: 36 months informal

Community Service: Permissible in some courts for repayment of fines


Second Offense and Subsequent Offenses:

Jail: 3-6 months required jail time, not to exceed one year.

Fines: $390 to $1,000 plus and additional penalties required

Suspension of Driver’s License: Mandatory 12-month suspension

Impound of Vehicle: Vehicle may be impounded and lost to offender in cases of multiple offenses.

DUI School: Usually 18-30 months, governed by whether it is a 2nd or 3rd violation.

Probation: 3-5 years informal without the necessity of reporting to a probation officer. Formal probation is necessary in cases where it is the third offense or further.

Community Service: 10 days mandatory community service as a substitute for jail time.
